1. Introduction

These Terms of Service ("Terms") govern your access to and use of Smart Printer - Print & Scan (the "Application", "App", or "Service") provided by HK MobiAura ("we", "us", or "our").

By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.

These Terms should be read together with our Privacy Policy and Subscription Terms.

2. App Store and Google Play Terms

If you download the App from Apple App Store or Google Play Store, your use of the App may also be subject to the terms, rules, and policies of the relevant platform.

In the event of a conflict between these Terms and mandatory platform rules, the applicable platform rules may control to the extent required.

3. Eligibility

You must be at least 13 years old or the minimum age required in your country or region to use the App. If you are under the age of majority, you may use the App only with the consent and supervision of a parent or legal guardian.

4. License to Use the App

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use, unless we expressly permit otherwise.

You do not acquire ownership of the App, software, source code, design, content, trademarks, or other intellectual property.

The App provides mobile printing, scanning, file import, photo import, document handling, contact printing, web page printing, printer discovery, print settings, print history, subscription, purchase restoration, and feedback features.

We may add, modify, suspend, or remove features from time to time. Some features may require an internet connection, local network access, device permissions, app store account, active subscription, compatible printer, supported operating system, system print service, or third-party service availability.

We do not guarantee that all printers, file types, web pages, network environments, print settings, or operating system versions will be compatible or available at all times.

7. Local Data and Backups

Some data may be stored locally on your device, including imported files, generated PDFs, scans, print history, recent printers, settings, and cache files. You are responsible for managing, exporting, and backing up local data where supported. Deleting the App, changing devices, clearing storage, or system failure may result in loss of local data.

8. User Content

You retain ownership of content you create, import, scan, select, share, print, or process through the App, subject to any rights required to operate the App.

By using features that process user content, you represent that you have the necessary rights and permissions to use, print, share, or process that content, including documents, photos, contacts, notes, web pages, emails, attachments, and scans.

You are responsible for the legality, accuracy, permissions, privacy implications, and backup of content you choose to process or print.

9. No Professional Advice

Unless expressly stated otherwise, the App provides general utility and productivity functions only. It does not provide legal, medical, financial, tax, investment, safety, emergency, or other professional advice.

10. Subscriptions and Paid Features

The App may offer paid features, subscriptions, premium tools, usage limits, advanced printing features, scanning features, file features, restore purchase, or other premium services.

Purchases made through Apple App Store or Google Play Store are processed by the relevant platform. Subscription terms, billing, cancellation, renewal, and refund rules are described in our Subscription Terms and the applicable app marketplace rules.

11. Third-Party Services

The App may integrate with third-party services, SDKs, APIs, platforms, app stores, payment processors, analytics providers, attribution tooling, feedback services, system print services, local printers, system share sheets, mail apps, WebView, and app store links.

Third-party services may be subject to their own terms and privacy policies. We are not responsible for third-party services, content, availability, security, compatibility, print quality, or practices, except as required by applicable law.

12. Printer, Web Page, and Network Compatibility

Printer discovery and printing depend on your device, operating system, router, local network, printer protocol support, system print services, printer configuration, and printer availability.

Web page printing depends on the website you choose to open, network conditions, system WebView behavior, page layout, and printer compatibility. Web pages may load incorrectly, change format, fail to load, or print incompletely.

13. Intellectual Property

The App, including software, design, interface, graphics, logos, text, features, and other materials, is owned by us or our licensors and is protected by intellectual property laws.

You may not use our name, trademarks, branding, or assets without our prior written permission.

14. Feedback

If you provide feedback, suggestions, ideas, or bug reports, you grant us a worldwide, royalty-free, perpetual, irrevocable license to use them for any purpose without compensation, unless prohibited by law.

15. Termination

We may suspend or terminate your access to the App if you violate these Terms, misuse the App, create legal risk, violate platform rules, or harm other users, us, or third parties.

You may stop using the App at any time. Uninstalling the App does not automatically cancel an active subscription. You must cancel subscriptions through Apple App Store or Google Play Store settings.

16. Disclaimers

The App is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, non-infringement, printer compatibility, print output quality, and uninterrupted operation.

We do not guarantee that the App will be error-free, secure, compatible with all devices, compatible with all printers, available at all times, or meet your expectations.

17. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, print output, local files, goodwill, or business opportunities arising from or related to your use of the App.

To the maximum extent permitted by law, our total liability for any claim related to the App will not exceed the amount you paid for the App or subscription during the twelve months before the claim arose, or USD 10, whichever is greater.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

18. Indemnification

You agree to defend, indemnify, and hold harmless us, our affiliates, officers, employees, contractors, and partners from any claims, liabilities, damages, losses, and expenses arising from your use of the App, your content, your violation of these Terms, or your violation of any law or third-party rights.

19. Applicable Law and Mandatory Rights

These Terms will be interpreted and applied in accordance with applicable laws and any mandatory consumer protection, privacy, data protection, subscription, refund, or other legal rights that may apply to you based on your country or region of residence.

Nothing in these Terms limits any rights that cannot be excluded or waived under applicable law.

20. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted in the App, on our website, or through other appropriate channels. The "Last Updated" date indicates when these Terms were last revised.

Your continued use of the App after changes become effective means you accept the updated Terms, unless applicable law requires additional consent.
